Probate (or Administration​/Reseal) Costs & Fees in the Australian Capital Territory - 2023/2024

Current Fees - 2023/2024 financial year

There are three main costs for applying for Probate (or Letters of Administration, or Resealing) in the ACT:

  1. Supreme Court of ACT Filing Fee
  2. Public Notice / Advertising Fee
  3. Solicitor Fee

1 Supreme Court of ACT Filing Fee

The ACT Supreme Court requires an application filing fee in order to assess an application for Probate (or Letters of Administration, or Resealing). The amount of the filing-fee corresponds to the gross value of the estate in ACT.

The following are the current filing fees for the respective estates, for the 2023/2024 financial year:

The gross value of the estate is found by summing the value of all estate assets located in the ACT, such as bank accounts, real estate, shares, acommodation bonds etc. Note: in most cases, super & life insurance are not included in this gross value calculation.

2 Public Notice / Advertising Fee

Prior to 1 March 2022, the court required a notice of any application for Probate (or Letters of Administration, or Resealing) for the ACT to be published in a daily newspaper circulating generally in the ACT. Fortunately, the court has replaced this outdated system with a new online notice system, which is faster and more affordable.

The cost of advertising the intent to apply for Probate (or Letters of Administration, or Resealing) on the new ACT notice platform is $57.00. We will take care of the publication of this notice for your matter at-cost.

3 Probate Solicitor Fees

Hourly billable rates / phone calls / printing / postage?.
